The filibuster exists in the Senate as each chamber making it's own rules is in the Constitution (Article I, Section 5).

They can't can't "legislate" (as in make them part of the United States Code) rules not in the Constitution, each chamber can create it's own rules. But then the DEMs can just change them back when they are in power.
