Not sure why you mentioned Hersh?
Kamala Harris was Attorney General when pot had not been legalized for recreational use yet.
And people were not arrested for marijuana use/possession. However, if they were arrested for other more serious crimes and there was evidence of marijuana possession, then it was added as a crime in many if not most, arrest cases ....and this was the practice for law enforcement in all states where it was not legal yet for recreational use, and still the practice by law enforcement in states who have not legalized it.
