Filling out a 4473 to take delivery at the consigned a FFLis the - last - step in the process. Prior to that, the ATF, after it runs the form 4 and form 23 approval process - including the same background check as when you buy a machine gun - has to give the OK for the transfer.

That is, the ATF did a background check on this guy, and passed him.
