Because Dems can't muster the votes to pass it. Hence they abused the SCOTUS to rig it. Hence why Dems are pissed that the people in states will get to vote on this vs being dictated to by the courts.

Obama never had a supermajority seated in the Senate, but was close in the first two years. When he was dealing with the economic crash and passing the ACA. After that his legislative agenda was thwarted by Mitch McConnell and his "do nothing" Senate.

Biden has a majority of one, so getting anything passed without reconcilliation, is nearly impossible.
