UN Resolution 181, partition Palestine into two states, one Arab and one Jewish, with Jerusalem placed under a special international regime. The text of the resolution mentions it throughout. General Assembly resolution are non binding. Even the UNSC resolution are unenforceable unless member states send resources to accomplish the objectives. In 1936 the Peel Commission first proposed and studied the Partition Plan. One of the drawbacks that were noted was that it would have to be implemented by military force and would need military force to enforce it in perpetuity.

An additional 511 dunums were irrigated or used for orchards,[20] while 26 dunams were built-up, urban, land.[21]

According to Benny Morris, the villagers of Najd were expelled by soldiers from the Negev Brigade on 12–13 May, 1948.

Following the war the area was incorporated into the State of Israel and the city of Sderot was founded in 1951 on village land, a few miles to the south of the village site,[17] while Or HaNer was founded in 1957 also on village land, to the northeast.[17]

The status of Palestine and the nationality of its inhabitants were finally settled by the Treaty of Lausanne from the perspective of public international law.

Drawing up the framework of nationality, Article 30 of the Treaty of Lausanne stated:

“Turkish subjects habitually resident in territory which in accordance with the provisions of the present Treaty is detached from Turkey will become ipso facto, in the conditions laid down by the local law, nationals of the State to which such territory is transferred.”

Henceforth, Palestinian nationality was first founded, according to international law, on 6 August 1924. And “treaty nationality in Palestine runs from that date.”139 The Treaty of Lausanne had transformed the de facto status of Palestinian nationality into de jure existence from the angle of international law.

The automatic, ipso facto, change from Ottoman to Palestinian nationality was dealt with in Article 1, paragraph 1, of the Citizenship Order, which declared:
