Both are true. Congratulations on coming over to the side of fact. I can't say much about the matter, because I didn't sit in that courtroom and listen to all the testimony, examine all the exhibits. Many very important facts have apparently never been reported in the news, or at least I've been unable to find any reporting about them. The judge knew these facts, though. He went outside of the sentencing guidelines because... why? Defense of male privilege? Really? It couldn't be because he felt it was in the best interests of justice? That he felt it was a really weak case?

Just curious, what if the judge is recalled, and then the conviction is overturned on appeal?

I would say that that the people got rid of an unpopular judge by legal means and that the law was served by the legal process of appeals. Nowhere is there anything in the law that even implies that the law is justice. if it were, O.J. would never have played a round of golf after the freeway police chase. Nor is there any connection between removing a judge, and the process of appeal...at least not in this case.

The AP, Fox News and other media outlets refer to Brock Turner as a convicted rapist.

The rapist also LIED to the judge about his history of alcohol, drug abuse and "aggressiveness" toward women.

Oooohh! CNN! Well, CNN is wrong. I think that's 126,394 times they've been wrong, but my count may be overly generous. The initial charges included rape, but those charges were dropped before the trial began.

Google it. I normally don't tell people to look thing up for themselves, but in this thread I insist. I hate seeing criminal cases tried in the court of public opinion, but if people are going to venture down that path, they better do so on the basis of FACT.

I posted what I found. That and the fact that the rest of the news media refers to him as a "convicted rapist". He was convicted of penetration of an intoxicated person and penetration of an unconscious person. The penetration was with his finger. In some states that is rape, and in others it is sexual assault.

Arguing such nonsense does not change the fact that the charges warranted prison time.
He was given prison time. Not enough, you say. What do you know about it, I say. What allows you to say you know better than the judge? Perhaps the judge felt that a miscarriage of justice had occurred. That either the jury or the defense failed to do their jobs properly. Perhaps that's why his sentence was light. What knowledge do you have, either of California law or of the facts of this case, which makes your judgement better than his?

For destroying a woman's life by committing one of the most heinous crimes possible, he received a couple months in the county JAIL, NOT several years at least, in PRISON.

The judge being recalled would not have any effect on an appeal. The reason being, the defense would NEVER appeal a victory. Perhaps they should push for a new trial?
