I did explain, and you accosted me for it, which tells me you were unable to explain it away. It looks like to me you are downplaying what happened in the Biden White House during his presidency.

First, it violates the constitutional order of succession under the 25th Amendment, and it also violates Article II of the Constitution. The 25th Amendment allows the VP to assume power if the President himself is unable to discharge his duties. But that was never invoked in his term.

It also violates 18 USC 912. By assuming his duties and powers as president, his staffers and advisers took on roles they were not constitutionally authorized to take, which violates federal law regarding impersonating a federal officer (assuming duties or authority of other federal officials outside the scope and bounds of their position).

If the president, under 3 USC 301, did not delegate his authority to his staffers and advisers, and the 25th Amendment was never invoked, and given what we know now about him, it is reasonable to assume they took on duties without proper authorization directly from the president. That violates the Constitution and federal law.

Under 18 USC 912, the offenders can be fined or imprisoned for 3 years, or both.

They did not follow the Constitution because the Chief Justice of the Supreme Court refused to preside. Had they convicted him, SCOTUS would have ruled it unconstitutional because it occurred after he left office. He was impeached during his term but the trial was not held until after he left office.
