It seems worth noting here that Cruz doesn't have to sign up through an Obamacare exchange. He could opt to purchase a private family plan off the exchange. Some of his Republican colleagues, also opposed to the health-care law, had previously told CNN they would do just that.

Yes he could have maybe he couldn't find one in the private market that meet his needs now that the requirements of indivivdual mandate part of Obamacare have caused many private insursers to drop many plans they previousley offered. Everyones insurance needs are different and I have no idea what his are or what type of plans are now avaviable in the private market.
