If you want to resist government tyranny as a CITIZEN then feel free to do so with the knowledge of the consequences, yes, there are times to stand up to the law. If a business or individual does not want to support gay marriage that is your right as a bigot. It is not an individual liberty that she can issue marriage licenses to whoever she likes, it is her JOB to move legal documents through the correct procedures, she can protest gay marriage all she wants from the unemployment line

Kim Davis was not hired. She was elected. The county clerk in Kentucky is mandated by state statutory law to issue marriage licenses to qualified applicants. The county clerk is free to delegate that statutory duty to one of her deputy clerks who had no objection. Kim Davis, in her official capacity as county clerk, is an agent of the state government. The state government does not have religious beliefs. The First Amendment prohibits the state from establishing religion. Kim Davis ran afoul of the First Amendment when she instituted an official policy to deny marriage licenses to qualified applicants based on her personal religious beliefs. As an agent for the state, Kim Davis cannot impose her personal religious beliefs on the public she was elected to serve. Requiring her to do perform the official duties she was elected to perform is not tyranny. She, on the other hand, is the tyrant. She is committing grievous tyranny against the people she was elected to serve.

The law protects religious freedom, which this is part of. There is no law that can infringe on free exercise of religion. If you insist she should be fired then there 1A protections mean nothing.

The law protects religious freedom, which this is part of. There is no law that can infringe on free exercise of religion. If you insist she should be fired then there 1A protections mean nothing.

When she is acting in her official capacity as the elected county clerk, she is an agent for the state ... and the state doesn't have "religious freedom". If she was a mere employee, she would be entitled to reasonable accommodation for her religious beliefs so long as the employer (the state) was not substantially burdened. A reasonable accommodation for an employee would be to assign the task to another employee who did not have a religious objection. Even Kim Davis, the elected official, could have assigned the duty of issuing marriage licenses to qualified applicants to one of her 6 deputy clerks. Instead, she instituted an unconstitutional official policy that gives supremacy to her own personal religious beliefs. We do not live in a nation where the people are governed by the religious beliefs of every petty government official. The First Amendment means what it has always meant. She is still free to believe anything she wants to believe, but she must still perform the official duties of her state government office.
