Nope. We make limited use of democracy to create our legislature. But we even further install a variety of safeguards there in the form of checks and balances. A majority of legislators agreeing to pass a particular law can’t do so unless that law is consistent with the Constitution.

It might be. But it’s not what we have.

And racial profiling is not legal.

Nobody says it is — and that’s NOT AT ALL what SCOTUS just allowed to stand as ICE policy (and it wasn’t ICE policy to begin with) even while they consider the decision below.
