Because challenging the subpeona if he'd declassified the documents would have made since. If he had declassified them there would have been no classified documents to return.

But he didn't challenge it because he knew that if he tried to claim in court that he had declassified them, them the prosecution could have challnged it under oath.

Trump would not have withstood a close examination and the additional perjury charge.
