Something Else That Trump Couldn't Be Bothered to Get Right: Termination of Union Members Have to Adhere to Their Collective Bargaining Agreement-CBA

Laws and rights?! MAGA is fascist.

Did you know that some people are so fucking incredibly stupid that they were easily brainwashed by the fake news into believing Musk was giving a Nazi salute?

Do you know any of those complete morons?

Part of the Executive branch. The firings will stand.
Government workers should never have a union. Government Unions are antithetical to the peoples' best interests.
They used to never be allowed at all. When did this start?

No they will not. The union contract will stand, and just like last time Trump fired all of these people without cause, the courts will stand by the workers and their rights. See McCabe, Strzoc, Page, and others.

Trump is still not king nor dictator. His overreach is really starting to piss off Republicans. Especially Red State Governors.

Their clearances are revoked and they are on notice. Wave bye-bye now. :D
Where is Strzok by the way? He probably shouldn't be doing any traveling.
Where is Jack Smith?

You keep telling yourself that ... Don't try to read the writing on the wall ...
It's an excellent example of how deluded people can get when they lose power and actually think the government can protect them.

As everything just slips further and further out of their grip ... I can only hope they continue the downward spiral they are in ...
Without realizing their resistance to the will of the People is what cost them the election.

Keep up the fight ... You make damn good cannon fodder.

I can't help but wonder why Trump appears to be in SUCH a hurry to burn everything down. So much so that he can't be bothered to do things the proper way so that he is obtains the results he wants, or in the very least, not have so many irons in the fire that it bogs down our government and prevents people from doing the work that they were hired to do.

UNLESS this is just a tactic.

When a federal employee is a member of a union, their termination must comply with the terms set forth in the Collective Bargaining Agreement (CBA) between the union and the federal agency. These agreements outline just cause protections, due process rights, and grievance procedures that must be followed before an employee can be fired.

Key Protections Under Federal Union CBAs:

  1. Just Cause Standard:
    • Most CBAs prohibit arbitrary or politically motivated firings.
    • The agency must provide documented reasons for termination, often including a progressive discipline process before outright dismissal.
  2. Due Process Rights (5 U.S.C. § 7513 & § 7121):
    • Federal employees cannot be fired without due process.
    • They are entitled to notice, a chance to respond, and an appeal process through the Merit Systems Protection Board (MSPB) or their union’s grievance procedure.
  3. Union Representation in Disciplinary Actions:
    • Employees have a right to union representation (Weingarten Rights) during disciplinary meetings.
    • The union can challenge unfair terminations through arbitration or legal action.
  4. Grievance and Appeal Rights:
    • Federal employees covered by a CBA can challenge their termination through a grievance process instead of (or in addition to) an MSPB appeal.
    • Many unions arbitrate wrongful termination cases, and arbitrators have the power to reinstate employees and award back pay.

How This Applies to Trump's Firings:

If Trump’s administration is firing federal employees who are union members, those dismissals must comply with their CBA protections. If the firings are politically motivated or related to retaliation against DEI programs, unions can file lawsuits and grievances to block the terminations.

Current Union Legal Actions Against Firings:

  • The National Treasury Employees Union (NTEU) has already filed a lawsuit challenging the reclassification and firing of federal workers, arguing it violates the Civil Service Reform Act and their collective bargaining rights. (theguardian.com)
  • The American Federation of Government Employees (AFGE) is also preparing legal challenges against mass firings. (marketwatch.com)
That must be why these federal employees have been suspended pending evaluation.

All of this is a "tactic". Flood the zone with so much bulllshit, that they can't fight all of it at once, allowing some of it to get through. The funding block won't stand. The firings will be costly, but the Justice Department firings will stand and these people's careers are over, simply because they did the jobs they were assigned to do, in prosecuting the insurrectionists and members of the prior Trump Administration.

Trump is trying to seize control of the public purse, and make his own decisions of what gets funded and what doesn't. That won't happen, because neither the House nor the Senate will be willing to give up what little power they retain.

Last administration, Trump took control of the Payroll Protection Plan loan program, and provided no accounting to Congress - ever. The Office of Budget Management has said that BILLIONS are missing and unaccounted for from this program.

I would also like to point out that Trump's threats against other nations are not being reported correctly in the US media. The government of Columbia didn't "fold" to Trump's demands over deportation flights. Quite the opposite - it was Trump who backed down.

The deportation planes were turned away because the idiots running this thing, failed to get the permission of the Columbian government to fly or land military aircraft in their airspace or in their country - AS IS REQUIRED BY INTERNATIONAL LAW. Colombia has been accepted 2 planeloads a week of US deportees for the past 2 years, but all of these flights were either charters, or commercial airlines flights.

Furthermore, the President of Columbia told Trump that no Columbians were to be sent home in shackles, or treated as criminals, during transport. Only after the President of Columbia received assurances of proper notification of flights, and humane treatment of its citizens, did the President agree to allow the flights.

This is what the rest of the world has seen as nation after nation stands up to Trump, and Trump tells the American people that HE is winning and the rest of the world is caving in to his greatness.

I'm a Canadian who lives in the real world, not the fantasy land that Trump has created for you.

Nothing is slipping out of anyone's grip except the sanity of the Trump Cult which has always been on shaky ground.

The problem with everything that Trump is doing is that it will negatively impact his base in a massive way. Elon Musk warned of the "temporary economic pain" to come, for working Americans, telling them it was necessary for the "greater good". This is the same bullshit line Republicans have been feeding to working Americans since Reagan was in office.

Reagan promised every working American a big raise, when the unions were gone. Workers are still waiting for that one.

Trump promised every working American a $2000 raise when he cut corporate taxes. 1% of workers received a small one-time bonus. Workers are still awaiting that raise, as well.

Instead, Trump is looking to end the minimum wage, cut Medicare and Social Security, as well as Medicaid, all to fund still more tax cuts for billionaires.

The left isn't going to "fight back" this time. They're just going to let Trump be Trump, and it's working. The nation is descending into chaos, and Trump is busy firing everyone who knows how to make the government work for the people.

Trump has done NOTHING to fulfill his promises of higher wages, and lower prices for the working men and women in the USA, which was the real reason why he was elected.

As James Carville recently said "It's ALWAYS the economy, Stupid!!!".

For goodness sakes ... If you read the articles associated with the funding blocks ...
Even the lawyers from Democracy Forward representing the LGBTQ Advocacy Group and others that brought the lawsuit ...
Indicated there is little chance the stay will accomplish anything in regard to reversing the policies coming that will end the funding.

People have to understand that for decades Republicans and Democrats in the Establishment ...
Have just been moving the deck chairs around as Compromise has been replaced with Compliance.
They have to understand that is reason why, at least the majority Americans that showed up to vote in the last election ...
Voted for the person who the nitwits hate the most.

They are simply sick of the shit ... Constant ineffective policies ... Or policies that are more destructive than beneficial.
They are not waiting for the opposition to agree ... They have listened to decades of crap ...
And Democrats have failed to provide anything better.

Never had them for over 200 years for good reason. That's taxpayer money they're collectively bargaining for.
you didnt answer my question...do public managers treat their employees better than govt ones?.....

you didnt answer my question...do public managers treat their employees better than govt ones?.....
I really wouldn't know, but the intuition is that they would to get better production out of their people.
Like for me, it would be buying the crew a nice lunch. Making sure they have drinks and snacks.

It's all a matter of how the administration goes about the firings. Sadly Trump has made his first mistake, by suspending those insurrectionists at USAID. They should have been charged with sedition. That is the proper way to move forward, as the Constitution does not offer any protections against sedition. Hopefully the administration will not repeat their mistakes in the future.

I guess it depends on who you ask and what you consider better treatment.

Working with people in both categories, some things (in general) are clear.
Private sector managers are free to apply and enforce higher standards on those they manage.

As far as treatment is concerned ... That practice can cause conflict with employees and most often associated with their performance.
At the same time ... It can push out employees that under-perform and create a better workspace for those who want to excel.

Ask the employee that gets pushed out or fired ...
They were not treated well and the manager sucks.

Ask the employee that excels and remains ...
The manager values them, and does their management job to create a better and more productive work environment.

So ... What do you want ... A system of meritocracy ... Or a system of protecting everyone at a cost to all ... :dunno:
