Smartmatic to sue FoxNews, Newsmax, OANN for defamation

Smartmatic Demands Justice for Defamation

Boca Raton, Florida - December 14, 2020 - Smartmatic announced today that it is issuing legal notices and retraction demand letters to Fox News, Newsmax and One America News Network for publishing false and defamatory statements. The demand letters identify dozens of factually inaccurate statements made by each of the organizations as part of a “disinformation campaign” to injure Smartmatic and discredit the 2020 U.S. election.

According to Smartmatic’s demand letters, these organizations could have easily discovered the falsity of the statements and implications made about Smartmatic by investigating their statements before publishing them to millions of viewers and readers. Smartmatic had nothing to do with the “controversies” that certain public and private figures have alleged regarding the 2020 U.S. election. Multiple fact-checkers have consistently debunked these false statements with stunning consistency and regularity.

“They have no evidence to support their attacks on Smartmatic because there is no evidence. This campaign was designed to defame Smartmatic and undermine legitimately conducted elections,” said Antonio Mugica, CEO of Smartmatic. “Our efforts are more than just about Smartmatic or any other company. This campaign is an attack on election systems and election workers in an effort to depress confidence in future elections and potentially counter the will of the voters, not just here, but in democracies around the world.”

Bring it. Discovery will mean they will have to open up their voting processes to scrutiny to fight off the claims.

After all, libel and slander require the offending party to actually lie and know the truth. The only way to know the truth is for Smartmatic to prove their software is untouchable.
False. The defendents will have to show why their broadcasted claims are not defamation.

Nope, the burden of proof on a libel or slander case, particularly against a member of the media, is on the accuser.
It's not a libel or slander case, you fucking idiot. It's a defamation case. The defendants must defend themselves in court. They must show the evidence that they had which informed their claims against Smartmatic.

Defamation, libel, slander, all the same thing, and all with the very very high burden of proof on the plaintiff.

Smartmatic has to show willful falsehoods against them, and to prove that discovery will include pretty much everything about their equipment.

Watch for Smartmatic to drop this before discovery.

This might well involve an interesting trip through the news-gathering and editorial operations of Fox, Newsmax, and OANN.

And, do you actually believe this corporate legal team bringing suit for Smartmatic are unaware of the discovery process in lawsuits?

Krebs CISA, Dominion Voting, Smartmatic, Malloch-Brown, and Elections
EI-SCC
As CISA Director,Christopher Krebs created an Elections Infrastructure Sector Coordinating Council (EI-SCC), composed of 33 corporate members, most of whom are election computer systems vendors. Normally, the government is responsible for inspecting vendors’ products, from soap bars to jets, on behalf of the end users – US citizens. However, Director Krebs did the exact opposite. Under his leadership, the CISA failed to inspect electronic voting systems. In fact, it specifically allowed malicious voting systems from Dominion, which had an election results editor on the backend . At the same time, Krebs put voting system vendors on the Coordinating Council for election infrastructure. This allowed the vendors to observe the voting and the voters. Yes, that included physical observation. Dominion boasted that hundreds of its employees were in the voting places.
This Elections Coordinating Council (EI-SCC) included Dominion Voting Systems, Smartmatic, and Spanish SCYTL (SCYTL might be innocent). Smartmatic is a Venezuelan company, headquartered in London and involved in election fraud scandals in more than a dozen places in the world. It is headed (through a holding company) by the former UN Deputy Secretary and head of Soros’ hedge fund British Lord Malloch-Brown, who was also just appointed by Soros as President of his Open Society Foundation. Allowing Smartmatic voting equipment in US elections, or inviting Lord Malloch-Brown’s men to participate in any elections related council is opening US elections to foreign interference of the most dangerous kind. Krebs did both. Since the CISA failed to inspect the electronic voting systems used in the elections, it should not claim that the elections were secure.
To note: Smartmatic is headed up by a holding company in London, England by the name of SGO. On their about page at sgo.com you can see two of the founders of smartmatic Anntonio Mugica-Director and Roger Pinate-Director, then Lord Mark Malloch-Brown-Chairman and Sir Nigel Knowles Director, who is, or was, associated with the old and prominent international British law firm DLA Piper, a international British law firm that Kamala Harris's husband Douglas Emhoff was, or is, working as an attorney. About - SGO
In addition to voting equipment vendors, the EI-SCC also included a pro-Democrat fake news outlet, two leftist groups, and Krebs’ former employer – Microsoft:

  • Associated Press, a Fake News agency
  • DemocracyWorks, funded by the billionaire Knight Foundation, is a far left electioneering nonprofit, specifically advocating for the deplatforming of conservatives and President Trump, during the pre-election period.
  • VotingWorks (VW) is another far left nonprofit, providing some voting technology, funded by Y-Combinator. It has been incubated and spun off by the Center for Democracy (CDT) and Technology (see VW & CDT sites). CDT supported Obamanet, then a rabid enemy of the Restoring Internet Freedom (FCC order). CDT also vehemently opposes securing the national telecommunications and IT infrastructure (including facebook, twitter, youtube, linkedin). According to CDT, the Silicon Valley corporations, which own and operate these critical internet communications (through Obamanet regulation), are entitled to do with them as they please.
(VotingWorks software was used by Georgia to audit the elections results. Apparently, this software (ARLO) was adopted by CISA and used in other states as well. Too bad – it is open sourced. Everybody can download the code and easily modify it for any purpose. “VotingWorks founder Ben Adida is a Trump hater who explicitly posted on social media ‘F*** Trump'” – TESTIMONY ON POTENTIAL GEORGIA ELECTION FRAUD By VOTERGA CO-FOUNDER GARLAND FAVORITO, DECEMER 4, 2020)

Microsoft is Krebs’ former employee. Its policies are far to the left. Surprisingly, Microsoft’s President Brad Smith wrote a book where he admitted to acting under the control of the Russian Government in respect to cybersecurity in the US, for more than two years. Clearly Microsoft is a very poor choice to help secure US elections against Russian interference.
