Should the Governor of NY state pardon Daniel Penny if he's convicted ?

UNless it's a 100% racist jury, no chance of a conviction. These people all ride the subway and they know exactly what Penny was dealing with.
The assistant DA referred to Penney as “the white man.”

Can you imagine if a DA referred to a black man charged with a crime as “the black man”?,
 
If penny is convicted and sentenced, will that dissuade anyone in the future from trying to step in and prevent a crime?

A lot depends on the jury instructions and how faithfully the jurors follow them.
 
with the juries looming possible guilty verdict of Daniel Penny [a man that many believe was protecting passengers from a dangerous man] about to be pronounced .. should the governor call for the pardon if he's found guilty ?

Does the Governor have a history of overturning juries on controversial cases?

But, that be the question if they seek to retain or move to higher office, in politics.
Nobody involved is of high social or economic influential status, so for pardons public opinion could be the coin of the realm, but with a divided public, it is risky either way, and the gov owes a certain allegiance and support to the legal and court system of the state. Not like Joe Schmoe on the street, with snap decisions based more on emotional appeal of the two competing sides, not having full access or the time to read every bit of testimony, and actual evidence. I would not be surprised if Gov stayed out it, certainly until the real public reaction works for a few months.
