It's the duty of the POTUS to appoint Justices to the SCOTUS. Republicans in the Senate might, and probably would, be seen as obstructing what is Constitutionally required for governance.

In an election year, that could hurt the GOP - which is already under threat in the Senate and the chance of a GOP POTUS - while still possibly resulting in a more liberal Justice being confirmed by a Democratic controlled Senate in 2017. It's a big gamble and one that most likely wouldn't turn out well for the GOP.

COTUS is clear, POTUS nominates and the Senate advises and consents to the nomination.

President Obama will do his duty and nominate a replacement for Justice Saclia, and the Senate Republicans, even before said nomination, will begin to assassinate the character of the unknown person as liberal, and one who will allow abortion up to the birth, the confiscation of all firearms from our citizens and the suppression of voting by anyone who has not given their DNA to a government agent.

It's clear, Sen. Cruz said so and he never lies. In fact the Republican's will once again vote in lockstop to deny President Obama his choice, even if Jesus Christ himself appeared with The President in the Rose Garden as his nominee,.

That said, if the President Obama nominates an individual with an impeccable record on the bench and in his or her personal life, and the Republican Senate assassinates his or her character based on "what if's" (see Cruz's comments from the most recent debate, as well as other comments by members of the clown car) we can once again point to the hypocrisy of the Republican's, and their propensity to put politics before their duty and the United States of America.

I always look to history to decide these questions. If, after the Constitution was ratified, citizens were required to join a militia, you would have a point.

Matter of fact, the founders felt the entire male population was the militia.

Rejecting a SCOTUS nominee is not a "do nothing" senate. They ARE doing their jobs, according to the Constitution.

If Obama doesn't select a person worthy of passing the nomination process he is the one that is blockading the nomination.

The founders certainly didn't put the senate in the picture to become a rubber stamp method of the presidents choice.

Obama is going to nominate someone who is very qualified who is just left of center... This will cause a problem to the Senate... Refusals to confirm President's nomination hurts the GOP Senate... Despite what the jackasses here say, the senate need a good reason to not rubber stamp the Presidental nomination...

They have a good reason. All they have to state is that they want to keep the court balanced.
