While actual treason may be a capital crime, I don’t see anything ever said by Ms. Cheney as constituting actual treason.

Even if her comments somehow did qualify as “treason,” the penalty doesn’t have to be the death penalty. (I agree with Darkwind wind on that point.) I’d oppose any such sentence even if she were ever to be tried and convicted for her ignorant commentary.
