He committed a crime by stealing. Any action during that incident should be treated as murder. He intended to hurt the person, and did so.

It's no different than if someone is being chased by the police and someone else uninvolved is killed as a result of that chase then they should be charged with murder because their direct actions caused that person's death.

Simple fact, the likelihood that this kid would go on to committing more crimes is virtually 100%.
Go on to commit more violence against innocent people? Almost certain.
That is inarguable.
If this piece of shit pushed a 74 year old woman, once more - 74 year old woman - hard enough that she bangs her head on the ground and dies - he should spend decades in jail. It will save a lot of other people a lot of grief and maybe even their life.
