I suspect no first-class jurist is going to accept a nomination under these circumstances. Why would they when you consider that they could only be confirmed under a cloud, if at all.

Obama picks a moderate and gets the Senate to prepare hearings on confirmation, then pulls the moderate and inserts an ultra liberal. Now he says the Senate is two-faced.

Even if the nominated person does accept and goes before the committee, it puts his whole life on hold and they would quit their job to accept.
Not many today would put themselves through that just to be rejected.

I don't blame him for refusing the offer.
