Sorry, they are not protected by so called PA laws.
Proving, once again, that PA laws provide unequal protection of law, in violation of the 14th Amendment.
Technically, they work around this by stipulating that "protected classes" aren't classes of people. Instead they are classification of reasons that are barred as justification for discrimination. And, or so the argument goes, everyone has a race (age, gender, etc ...) and is equally protected from discrimination based on bias against race (age, gender, etc ...).
But, as is the case with so many important legal principles, it's the "Reader's Digest", dumbed-down version that enters public consciousness. To the point that the dumbed-down version replaces the original concept. That's happened here. Most people, even many legislators and judges, seem fine with the idea of special rights for special groups. They don't understand, or don't care, that this undermines equal protection.
