A 67-year-old man who fatally shot a would-be mugger during a robbery gone wrong has been jailed for four years.

Charles Foehner, from Queens, New York, appeared stone-faced as he arrived at Queens County Criminal Court Thursday morning for sentencing.

Foehner, a retired doorman, was walking to a parking garage outside his Queens apartment when the alleged mugger lunged at him with a sharp object about 2am on May 31, 2023.

In most states the mugging victim would probably walk.
NY seems to favor the criminal over the victim.
Society will eventually break down if crime gets out of hand.

He was convicted of having an "arsenal" of unlicensed guns in his apartment. Not for shooting anyone.

Why can't you people ever tell the truth?

Foehner was charged with 26 counts of criminal possession of a weapon, but did not receive any charges related to the fatal shooting.

Lie by omission on your part. You should have read more closely.

The man was carrying a pen, and got killed for it.
 
The mugging victim received 4 years for unauthorized gun possession in NY.
Can you get authorization for a gun in NY. If so, he should have done that.

Still 4 years (and out in 18 months probably) is better than becoming a mugging/murder statistic.

I wouldn't want to be stabbed with a pen, by some crackhead demanding my money. I might have shot him, also. Of course, my weapons are legal, and I am authorized to carry concealed or open. But, I live in a normal state, not New York.

who has the time in the moment to figure out if its a pen or a knife? A pen in the neck can be painful as well I bet.

And I hope he appeals it to SCOTUS, if you have to pay the State to own a firearm then it's not a right as defined in the Constitution, it's an infringement on that right.

Sure, nobody would. However producing a gun would probably have been reasonable "force". Had he pull out the gun and then was attacked, he probably wouldn't be going to prison.

He used EXCESSIVE FORCE.

Don't take the chance and do not let them close the distance, with your weapon still in the holster. Better ammo, would mean you probably do not have to empty your weapon. If I did empty mine into them, I would probably be facing charges, as some of them would undoubtedly be after he was laying on the ground. I carry 15 and 1, all of them Federal LE/Personal defense rounds.

A couple of strikes to the throat with a pen can kill you just as dead as any gun or knife can.
