The Pennsylvania Supreme Court ruled Monday that mail-in ballots with incorrect or missing dates cannot be counted in the 2024 election, delivering a victory to Republican Party officials as they moved to aggressively defend their narrow Senate victory in amid a recount challenge in the Keystone State.

In a 4-3 decision, the state Supreme Court reaffirmed its prior decision that counties in the state cannot count incorrectly dated or undated ballots, explicitly singling out Boards of Elections in Bucks County, Montgomery County, and Philadelphia County, whom they said "SHALL COMPLY with the prior rulings of this Court in which we have clarified" for mail-in and absentee ballots in their Nov. 1 ruling.

The decision is a victory for Republican Party officials, who had filed 12 different lawsuits in the state amid an aggressive Senate recount effort following the narrow victory of Republican candidate David McCormick over three-term Democrat Sen. Bob Casey.

It was 2022, and a primary election. The law was not settled, there were conflicting court decisions at that time. By the time of the 2022 General election the matter was settled by the Supreme Court and the 3rd Circuit, the dating requirement was not unconstitutional and the ballots could not be counted if they were not dated, as per PA election law.

That was upheld again by the PA Supreme Court September this year. There was no legal rationale to be ignoring the court now, and the decision called out those counties in some pretty strong language.

Why didn’t they have the law breakers arrested, or hold them in contempt of court?

But it was the law when McCormick went against it, regardless of it not reaching a State Supreme court decision.....

Just like these rogue counties....though as you indicated, with these counties, the supreme court of the state had made a final decision and ruling.... I agree those county board members doing this are wrong!!!

Yes, it can be appealed and go to the federal and supreme court....I'm guessing? So it may not be settled yet? But in the mean time, follow the law!

Like Progs do, maybe the officials who made their own interpretation to let the ballots be counted should have people protesting in front of their homes in the same exact way. Open season on the family.

But I think like McCormick did, it is unnecessary to have a date on the envelope to ascertain the voter is a registered voter and citizen....and is just messing with counting a citizen's constitutional right to vote for their representation.... It should be banned, Nation wide!
 
Casey is a looser. He got into politics on his governor father's coattails. He has not done a useful thing since. Every six years he pokes his head up for reelection.

We have people questioning elections. The people who use pure partisan politics on it, should be tried as insurrectionists.

I'm agreeing everyone needs to follow the law and court ruling, the counties bucking that, are WRONG to do so...as long as it is still law.


But what I am saying, is I believe the law, needs to be changed, through legislative law or via a US Supreme court ruling, because we have a right to vote, and we also have a right, for our vote to be COUNTED....

Nullifying a citizen's vote because an envelope was not dated, is a frivolous reason to eliminate a citizen's vote, from being counted....it serves no purpose....
