The Judge is an appointee of the Clintons and should have recused himself. The defendant in this case actually endorsed the Clinton candidacies several times.
 
The NYTs v. Sullivan standard was maintained. Let us hope SCOTUS does not reverse it.

It's extremely difficult for a public figure to win a slander/libel lawsuit. Their status as a public figure makes them more of a “fair target” for any criticism, and makes a much harder standard to meet to establish that any criticism was so false as to be a tort.

I have to disagree with the judge's statement that “…her lawyers failed to produce evidence that the newspaper knew what it wrote about her was false or acted recklessly towards indications it was false.” The connection between anything that Mrs. Palin said or did, and the 2011 shooting spree, was certainly something that the newspaper ought to have known was a rather extreme stretch, ought to have known was almost certainly false.

But I would have to be concerned about a precedent that it might set for Mrs. Palin to win such a lawsuit. I think the article linking her to the shooting was, indeed, libelous, but it falls along a line of speculation that in other circumstances, might be justified, and which would be unjustly chilled by this precedent.

It's also difficult to see what damages Mrs. Palin could really claim. I doubt if anyone changed their opinions of her on the basis of tha article. Those who hated her already hated her the same before the article, as after, and those who liked her saw the premise of the article as absurd enough not to give it any mind.

It leads to the defense against slander/libel on the basis that the slanderous or libelous statement was so stupid that nobody should have believed it anyway.

While the jury was deliberating this case some fucking judge decides to say that the case has no evidence?

As he issued his ruling, Rakoff gave the Times a mild tongue-lashing.
“Ms. Palin was subjected to an ultimately unsupported and very serious allegation that Mr. Bennet chose to revisit 7 years or so after the underlying events,” the judge said. “I think this is an example of very unfortunate editorializing on the part of the Times but, having said that, that’s not the issue before this court.”
The case is in the hands of the jury.
He can't throw it out after the case goes to a jury just because he "feels" the plaintiff didn't prove their case.
He has to go thru a proper process. And during a trial the plaintiff can declare prejudicial treatment by the judge and move for a mistrial if they don't get a positive result.

"The decision Monday was the second time Rakoff has thrown out the case. He did so in 2017 after an unusual hearing in which Bennet testified about his decision-making related to the editorial. The 2nd Circuit Court of Appeals later reinstated Palin’s suit, calling Rakoff’s approach unorthodox and in violation of federal rules covering civil litigation."

It never before occurred to me to seriously look into this. I knew that the original occurrence of “I can see Russia from my house” was not from Sarah Palin, but from an SNL actress mocking her. But Mrs. Palin really did say, “They're our next-door neighbors and you can actually see Russia from land here in Alaska, from an island in Alaska.”

Was she correct?

She didn't say she could see Russia from her house. She said that Russia could be seen from an Island in Alaska.

I present to you, The Diomede Islands. Little Diomede Island is part of Alaska. Big Diomede Island is part of Russia. The distance between the two islands is less than two and a half miles. Mrs. Palin did say that it was from an Island in Alaska, that Russia could be seen. Do you suppose that from one island, one would be able to see another island less than two and a half miles away?


Now, if we ignore the Diomede Islands, then the nearest part of mainland Alaska to the nearest part of mainland Russia would be Wales in Alaska, which is about fifty-four miles from the nearest part of the Russian mainland. I wouldn't know for sure, but it seems plausible that you could see Mainland Russia from there.


And on another note, there are the islands trailing eastward from Alaska. Some of these islands are real, and well documented. But there are an appearance of islands that are not really there. You think you see them, but if you sail up to them, there's just water. Those are the Optical Aleutians.

This judge got called out on procedure once before in this case, looks like he is setting himself up for another slapdown.
