The expression, "out of them mainstream" has no legal meaning. It has no Constitutional meaning. It is NEVER used by Conservatives, Constitutionalists, or even constitutional moderates.
It is invariably used by Leftists to describe concepts and people with which (whom) they disagree, when they do not have a substantive reason for their disagreement.
You will hear that expression endlessly in the coming days and weeks, as Leftists in Congress do their best to slander Trump's USSC nominee, Judge Neil Gorsuch, and delay or defeat his nomination.
But if they think they are going to Bork this guy, they have another think coming.
Remember, to most of these Leftists, the Constitution itself is "out of the mainstream," and especially troublesome parts like the Tenth Amendment.
