Once Upon a Time, the DOJ Argued the Presidential Records Act Gave a President Massive Authority Over His Records

There wasn’t a negotiation. He received a grand jury subpoena for all documents with classified markings.

End of negotiation.

Trump is a liar, so what he says isn’t all that important.
Trump was negotiating BEFORE the subpoena and, even if they were marked classified, he could have declassified them while POTUS. You don't seem to have any understanding of this issue.

Show the 'legal standard' that says a POTUS can't declassify documents at any time.
Trump admitted he didn't declassify. So is a Blue Police Box included in your imagination?

Perhaps a Delorian going 88 miles an hour?

Then Trump should have said so, otherwise the DoJ would have no idea.

Any way you slice it, it’s Trump’s fault.

Months after Trump's departure from the WH, Trump's lawyers were contacted about 'missing records.' Those records were returned to Archives in January 2021. In those 15 boxes were supposedly classified material that was retrieved by the DOJ before the Mar A Lago raid.

There is no 'tape' there is a highly edited digital recording.

Says you, citing your imagination.

And your willful igonrance isn't a legal standard. And thus irrelevant to any legal outcome

As your argument is no longer a legal one, but merely making up fantasies to ignore evidence....I accept your concession.

He is not being charged for classifying or declassifying information. Are you saying that a President can declassify ANY document and take it with him when he leaves the WH?

Yeah, that's EXACTLY what the Constitution says.

You should read it sometime.

Your argument is that unelected government bureaucrats get to DICTATE what the laws of this land are. Not the PEOPLE who ELECT people to REPRESENT them.

So, are you in favor of a dictatorship, or are you for a republican style of government?

Yet another dumbshit who has never read the COTUS.

That’s more accurately applied to Ken Starr than Jack Smith.

This isn’t a situation where the DoJ was just looking for anything. It started because NARA had to keep harassing his staff to get important documents back to be saved in the archives. Once NARA found classified documents, they got the DoJ involved.

Are you surprised that the DoJ would take this seriously and demand the classified documents back?

Jack Smith has abused his power more than any other prosecutor in history. His "legal theories" have been laughed out of Court more than any other. If the legal system were truly a justice system this fucker would be under the prison, where his unethical ass belongs.

Yeah, the COTUS doesn't say that an ex-president can keep classified docs. Or lie about them. Or refuse to return them. Or compell others to lie about them. Or obstruct justice.

If you believe otherwise, show us where in the COTUS it says so.

I won't be holding my breath.

True or False?

"4. At 12:00 p.m. on January 20, 2021, Trump ceased to be president. As he departed the White House, Trump caused scores of boxes, many which contained classified documents, to be transported to The Mar-a-Lago Club in Palm Beach, Florida, where he maintained his residence. Trump was not authorized to possess or retain those classified documents."

Trump had every right to those documents.

Due process isn't an abuse of power. Jack Smith didn't indict anyone. The grand jury did.

Jack Smith LIED to the Grand Jury, and didn't present a single bit of evidence that exonerates Trump.

Yep. Which prompted the DoJ to issue a subpoena for any remaining classified documents.

At no time did Trump tell anyone these documents were declassified.

They didn't need to issue a subpoena. Trump was cooperating.
