#1 Please review the Presidential Records Act of 1978 - link below. Specifically what are Presidential Records and what are Personal Records. Then the part that says specifically: "
§ 2202. Ownership of Presidential records The United States shall reserve and retain complete ownership, possession, and control of Presidential records; and such records shall be administered in accordance with the provisions of this chapter."

#2 The Presidential Records Act is civil procedure, as such it doesn't even apply to national defense information (classified information), which is covered under the Espionage Act which is criminal in nature. Remember Trump - a civilian - was NOT charged with having the classified documents, he was charged with refusing to return them when ordered by officials of the United States Government (National Archices, FBI, Federal Subpoena) and obstructing justice in attempting to hide them from agents serving a Federal Court issued search warrant.
