A Guatemalan crossing the border outside of the border crossing entry gates, is an asylum seeker.
The Law states that the illegal from Mexico when caught by border patrol can immediately be sent back to Mexico because Mexico's border touches ours.
BUT the Guatemalan crossing our border, is considered a person seeking asylum refugee status because their border does not touch ours. The Law states that we must take them in, and give them the opportunity to file for refugee status before a Judge in our Immigration court.
The only way to help this problem of so many Central Americans seeking asylum here and the back up and overloading of our detention centers while they wait for their hearings, is to expedite their court hearings... fill the immigration courts with more Judges so the process is lickity split instead of an 8 week wait. Most applying are being rejected for Refugee status, and sent back to their homeland.
And then work on a long term solution to keep them away from coming here, through diplomacy actions and interactions with their governments... imo.
