Cohen was charged in federal court for the METHOD OF PAYMENT for the NDA, not for the NDA itself. Trump was charged and convicted of business fraud in laundering the money to pay Cohen back through is business.



That is a lie, I don't maintain NDA's are illegal, they are legal.

However the method of payment was illegal, but that is a separate legal issue.

No. The NY State Court of Appeals (the state’s highest court) comes after the en banc decision of the appellate division (if they agree to go en banc). If not, the appellate division decision goes to NY State Court of Appeals more swiftly.

When (if) they affirm the decision, the next step will be SCOTUS.

Because SCOTUS has jurisdiction over the determinations of a state’s highest court ruling.

None of that testimony has anything to do with any official acts, so there’s no reason to remove it from the trial. Their conversations were not subject to immunity.
