The "legal status" you speak of - asylum seeker status is not legal if obtained illegally. Asylum laws require reporting to a port of entry and making a truthful claim of refugee status. Sneaking over the border to look for a better job, or to deliver fentinilo, getting caught, and only then asking for asylum while making a false claim of oppression is not legal, so they are indeed illegal aliens.
