Most seek out border patrol which is the first step in declaring protection status. What's criminal is for them to be released and not contacted for the next 2 to 7 years when their case comes up. Meanwhile, they are subject to deportation although they tried to play the game. You want to get legal deportations, get the courts where they can do the court date in 30 to 60 days. Like in most embassies, only 15% will be granted assylum and the second the gavel falls, the ones that aren't granted assylum should be boxed up and sent to their country of origin. Do things right for a change.

If the court rules that they don't get asylum, they are bagged and tagged right then and then immediately sent back to their countries of origin. No fuss no muss. And all that was in the most recent HR bill that your Orange Cheeto decided he didn't want it to be done until after he gets back into office.
