Actually, anyone given a minor that weapon for anything other than a SUPERVISED hunt is subject to misdemeanor penalties. Junior not only was illegally in possession of that weapon, but discharged it unlawfully and subsequently caused the death of another person. Adding that he's an out-of-towner isn't helping his case.
