You're also wrong about the entire case hinging on his illegal possession of the gun. They can also argue excessive force. They can argue mishandling of the gun. They may have witnesses to justify Rosenbaum going after him.

Prosecutors can go get their own self-defense expert, if anyone is willing to testify (probably not). Otherwise, that testimony would be incredibly helpful and the jury will hear the testimony.

Not really the issue in the trial, though. The prosecution is going to argue that, since Kyle was there illegally and possessing a weapon illegally, he does not have the right to claim self defense. And they are going to argue to his intent.

And, that is an argument that has failed an innumerable amount of times. Felons in possession of firearms have been cleared of all charges except unlawful possession of a firearm in a shooting where self-defense was necessary.

Self-defense requiring deadly force takes all other legal issues off the table.
