Even the Obama admin deported illegal aliens without a judicial hearing.

I'm glad some Democrats watched that since it was on MSNBC.

This is what Bondi and Noem mean when they say even if Abrego Garcia comes back, he can (and definitely will) be removed immediately under Expeditited removal as proudly signed into law by Bill Clinton.

I love how the MSNBC lawyer has to warn the liberal viewers not to get their hopes up that their wife-beating, human-trafficking hero will get to stay forever.

The lawyer did a decent job explaining it. Doubt he'll be invited back to MSNBC

Because he was in the country for more than 2 years, I doubt they could use expedited removal. He'd be allowed a hearing.

But, I don't see any reason they can't have that hearing while he's in El Salvador. We held administrative hearings via video for several years during COVID.
 

What due process hearing.

They are illegal.

My statement about due process was that he had a non-deportation order. If that is true, he is owed due process (it had already started).

But for most, it is in the van, on the plane and out the door at your country of choice (or whatever).

But if it's a due process hearing, he can go before an immigration judge who will lift that absurd "I'm scared of a gang that no longer exists" excemption and send his ass right back home. Only this time, he won't get out of the Supermax.

Since there is no release to facilitate, do the other thing by sending that same immigration judge to let him call as many witnesses as he can find who will testify on his behalf. Find that he belongs in El Salvador (duh), and it's done.

Garcia already had a hearing and was deemed deportable. However, even people in expedited removal processes have the right to claim asylum, which Garcia did. That claim also failed because of timing, however he successfully argued fear and harm by returning to El Salvador and was granted a withholding order.

That’s why Trump’s deportation of Garcia was illegal. Not because he wasn’t deportable, but because Trump ignored a court order to not send him to El Salvador.

Garcia was denied the chance to challenge his illegal deportation in court to prevent it from happening. Call it what you want, that sounds like lack of due process to me.

It is pretty much as you laid out - El Salvador got Barrio 18 under control - the only reason for his removal withholding. Should be a half an hour hearing.

I suspect the DOJ is dragging this out a bit because the Dems are digging their graves deeper and deeper each day that passes.

That's absurd. He got plenty of due process. He got exactly the ruling he asked for.

Then . . . because of an administrative error, he was deported to the wrong place.

It's an error easily fixed by having another hearing in which the immigration judge will remove that restriction on deporting him to El Salvador. Once that is done, he's in the right place. Problem solved.

The admin can make their case on why the Court Ordered halt on returning him to ElSalvador be revoked, and Garcia and lawyers can make their case on why the protection should not be removed...

Don't think the video hearing would work, without Garcia having free and private access to his attorneys ahead and during hearing??? But who knows, maybe it could work?? :dunno:

Garcia can’t have the order removed until he’s back in the United States to defend himself.
