Which is actually not applicable. Because first you would either have to prove they joined for financial gain, or that they were there to overthrow the legitimate government.

Now, if there was an actual call out for pay for people to go to Ukraine to fight, then it might apply. But there is nothing under that that covers volunteers.

And the same with the government. Now when the President of Haiti was assassinated last year, those were mercenaries that fall under that as they were fighting to overthrow the government of the country they were in. However, fighting for Ukraine in Ukraine does not apply.

No, they are not. Citizenship is not required. And in fact, when they were captured they were actually in a military uniform. Which is far more than we ever saw from the Jihadis in the Middle East and elsewhere in the last 2 decades. Under both Hague and Geneva, they are not mercenaries and are entitled to POW status.

Yes, that is dated 2020. However, he left the US in 2018, therefore is not liable for litigation as he has been overseas for almost 3 years and is likely to ever return. Unlike a criminal prosecution, civil lawsuits have no way to force the return of litigants.

I think it's just about universally recognized that Taiwan is part of China. The agreements are that China would not take control over Taiwan by force, and Taiwan would be independently governed.

In exchange, the PRC became the recognized gov't of China, and China got a seat on the UNSC. Taiwan got a security agreement from the US (just like Ukraine got in 1994).

This is the dilemma Xi is in. He cannot recognize the LNR/DNR (or South Ossetia) without undermining the "One China" policy. If some part of a country declares independence, and that is all it takes, then Taiwan would be also free to declare their independence from China, and other nations would be free to recognize Taiwan.

Xi will not go down that road. He's watching Biden. A feeble response in Ukraine- if the US waffles on the 1994 Budapest Memorandum, how serious will we be about the TRA?

Wrt the OP. The DNR is not a recognized government and their kangaroo courts have no legal standing. The belligerents in the conflict are Russia and Ukraine, and those governments are responsible for the safety of POW's and detainees. No one else.

Russia cares nothing for the law, but unless they want to see about 400 HIMARS launchers and a few thousand long range GMRLS in Ukraine, they better think twice about executing POW's...
