How can her rights be violated? No One has a RIGHT to a Prom. And the school is NOT holding a Prom. The Judge is an idiot. Is the Judge going to ask the Federal Government to pay for this Prom? This loses on every level.

she's american, and the judge held that her 1st amendment rights were violated.
he's decided to have a trial; it seems like the right thing to do, imo.

Why does it matter if her family is Mexican? She is still an American citizen and her rights were violated.

She isn't the one who violated someone's rights, and she isn't the one who canceled the prom. And selfish? Are you kidding me? THEY VIOLATED HER FIRST AMENDMENT RIGHTS.
We had a lesbian couple at my prom, NO ONE cared.
Of course if this had been a white christian, I am sure you would feel completely different about the subject.

Some schools are like that, they don't care.
Freedom of speech in the United States is protected by the First Amendment to the United States Constitution and by many state constitutions and state and federal laws. Criticism of the government and advocacy of unpopular ideas that people may find distasteful or against public policy, such as racism, sexism, and other hate speech are generally permitted. There are exceptions to these general protection, including the Miller test for obscenity, child pornography laws, speech that incites imminent danger, and regulation of commercial speech such as advertising. Within these limited areas, other limitations on free speech balance rights to free speech and other rights, such as property rights for authors and inventors (copyright), interests in "fair" political campaigns (Campaign finance laws), protection from imminent or potential violence against particular persons (restrictions on fighting words), or the use of untruths to harm others (slander). Which part was violated?
