Mental Health Evaluation

Why do the courts require a mental health evaluation as part of a punishment?

I haven't heard of that as a routine part of punishment.

On the other hand, from what I know of your recent legal and professional woes, it doesn't seem at all unlikely that there might be concerns about your mental health. The behavior that got you in trouble, got you convicted of criminal behavior, got you a couple days in jail, and got you removed from a position that you had held, is not exactly the behavior of a man who is in good mental health.

Let’s say you are ordered by the court to have a mental health evaluation and the auditor says, “yep. He is cuckoo.” Then what?

Let’s say you are ordered by the court to have a mental health evaluation and the auditor says, “nope. He is not cuckoo.” Then what?

It is a zero sum game. It accomplishes jack squat.

That's beyond my pay grade.

I guess it creates a record of whether you are officially cuckoo, or officially not cuckoo. Have you been sentenced, yet? Perhaps they'll take your mental health or lack thereof into account.

Oh, yes, there it is. A suspended fifteen-day jail sentence, (in addition to the two days you already had for contempt), a year of supervised probation, and an anger management assessment*. And you are not to make any attempt to contact the prosecution witnesses (meaning the people who you were convicted of stalking/harassing, I presume).

* Is that what you are referring to, as the “mental-health evaluation”, or is that something else?

Usually it's to see if they are fit to stand trial after being charged.....It's not a punishment.

Psychiatric counseling can also be part of their release plan in lieu of or after imprisonment.....Again, not a punishment.

Not necessarily. Take NYC for example. Adams has decided that for the safety of the citizenry, cops can choose to pick up homeless people and essentially "commit" them for their own safety as a result of an assumption that they are dangerously mentally ill or incompetent.

They may only be held briefly but I'd guarantee that it will qualify them for being forever refused the ability to legally own a firearm.

They probably want to get some idea of how likely you are to commit more crimes, similar to that of which you've already been convicted.

Of course, you should probably be having this conversation, as well as several others you've brought up, with your lawyer, rather than with unqualified strangers on an anonymous message board, most of whom don't even know what the mess is that you've got yourself into.

I only know because you briefly let slip, in a now-deleted thread, enough information that I was able to google some of the details, and find out who you are, what position you used to hold, and find all the various news stories about you and your antics and resulting legal problems.

This thread isn't about me goofball.

Probably because criminals are more likely to suffer from mental health problems.

If you struggle to hold down a job, how do you get money? If you have lots of issues, crime might seem like an easier solution to your problems.

"Over half of prisoners have poor mental health including depression, post-traumatic stress disorder and anxiety"

"Around 15% of prisoners have specialist mental health needs"

"Around 2% are thought to have acute and serious mental health problems"

You saw the media's version.

Basically what happened is I got in an argument over text where I said mean things. That's it.

The judge said because she asked me to stop texting twice during the argument then it was 2 or more unwanted contacts. Two or more unwanted contacts is the legal definition of harassment. Since it was done over text it was cyber harassment aka cyberstalking. If that is a crime then I have committed it trillions of times on this site alone and will commit that crime trillions of more times. Most sane people would block the number if they didn't want to be contacted. Believe what you want. She wanted me to keep going and going so she could document it. That is wanted contacted not unwanted. You have to keep in mind I was an elected official at the time. It would have been really bad for an elected official to go Scot free even if the charges were bogus. The judge was protected his reputation and mine by finding me guilty. You could have done the same thing and the judge would have laughed his ass off at this psychotic bitch.

If you believe it was more than that then enjoy the value that your creative imagination affords you. I was a full blown disgusting filthy rotten good for nothing dick headed assholish jerked but not a criminal. That's not the same thing.
