Its the senate that confirms the president picks... and presidents going back to Clinton have all made recessed appointments although none have used it for cabinet picks... but the law says they can... now the senate if the dems had the majority could have a senator go to the chamber every morning and open the session and come back in the evening and gavel it closed...
