You would have to ask the Jury. Obviously, the Jury was not convinced, especially without the pilot's testimony.
In case you are not aware, that helicopter is equipped with sensor for lasers as part of it defensive system, that alerts on laser designation and other lock-ons, similar to fighter jets. It is doubtful a laser beam crossed its path, and they failed to illicit a confession, but chose to go to court anyway, to chalk up the loss.

You don't get a hung jury in 35 minutes on a felony charge. No judge would accept it. The voted and the vote was not guilty.

Surprising, so have I -- Exactly 3 and yes I was foreman on one as well. All were found guilty. And yes, I am very well versed in how it works. If you think that one juror cannot nullify a jury, you are more ignorant than I gave you credit for.
