Man blocks black delivery driver in Oklahoma neighborhood

I think the driver could have provided that information however holding the men hostage for
an excessive length of time was also wrong and ill advised.

The law calls that harassment.


If I were visiting someone in a gated community, and I was stopped by and asked who I was there to see, I would have just told them. And I would have been nice about it to, not peevish like this doofus.

I would've said who the fuck are you?/move your goddamned car cause I have work to do, or I'm calling the cops!

Me too. I go to lots of places lots of rules. I was once detained at Nasa Stennis Space Center for three hours for taking a picture. I didn't see the sign that said no photographs.

I didn't cry. It was my fault. I didn't see the sign, but I agreed to the rules by entering. Lots of places one enters require following rules.

This place was no different.
Well we don't know if any rules were posted outside this gated community. I've never seen that before
and I've serviced lots of places like this. Purely by the fact that a home owner gave these delivery drivers the
gate code that constitutes an obvious form of permission to enter.

I can't fault the driver and helper for doing what they were supposed to do.
I can only find fault, and possible legal ramifications for the vigilante who held these two men for a whole
hour and once more I can't ignore the race factor here.

It's the only thing that would help explain the actions of this fool blocking the truck.

Correct. If is single gated house, and you give out code to the gate to your house, that is your problem. You don't give out codes to the gate that give access to all other houses. I used to live in gated community, if there is a delivery, either they call me from the gate to open, or I wait for them at the gate.

Does anyone here gives out alarm codes to their houses?

Quite possibly. At that point the man holding the truck hostage should have phoned the police and then let the truck go. Why didn't he do that?
No one was held hostage. The driver had a phone...if he was a hostage...why didn't he call the police?

The HOA representative DID call the police. Is he required to move his vehicle. Is parking ones vehicle across a private road a crime?

Not a private road cause the public has access. If he had been drunk, he could still get busted for a DUI on a HOA road.

Although, there are locks today that can be programmed to give "one time" access. When my neighbor was on vacation, he asked me accept delivery for him. I thought he wanted me to take it to my home so it doesn't get stolen, but he gave me "one time" code to open his home and drop the package inside.

Now, if someone seen me opening his door, and asked me a question what am I doing, I have no reason not to tell them. I would do the same for my neighbor.

No, they either check in at the security gate if it's during the day, or they use the call box and the residents enter a code on their phone to open the gate...

I don't think "everyone" was given these codes. I don't know why you do except to make your really
weak case seem somewhat strong. You certainly haven't shown that to be the case.

I hate HOAs...not because off the security aspects...but the control aspects. If you want a say in what I do on my own property...you should have bought it. I have enough trouble with the cities codes...but my wife likes the security of having the cop shop three blocks away.

I used to live in one, and it's been OK for awhile. Until my wife wanted to replace front door with one that has glass panels. Soon after I got letter from HOA that I have to paint door from white, to one of two colors approved by HOA. Second time letter stated that it was not right shade of green. I hated those little details, but at the time I was complying with them because I lived there. Moved out some six years ago to a new house, still on private road, but not gated.

So...why didn't he call the police? I had a guy who would move blocking me from making a turn...refused to back up...and I couldn't back up. I have it on video. I called the cops. In 15 minutes they showed up and made him back up. No big deal. The guy was a dick but I wasn't going to just sit there and I couldn't force him to move. Same deal here. So why didn't he call the police?

The public has access to HOA roads. So public law applies to HOA roads except for one, and only one difference. And that is parking. Just like a private business can set rules on parking as long as they post signs, violaters will be towed, no parking signs, etc.

When I drove delivery for a local paint company, I got stopped by HOA folks all the time down in the Potomac area. I just cooperated with them, gave them the info that they thought they needed and was off to do the delivery.

Why did the driver not tell them who the delivery was for?
