Police that investigated the scene didn't consider that to be the case hence charging him with attempted murder. I asked the cop to ask the person if they had been using their phone at the time of the accident, or check it for activity, but the cop claimed he had no right to look at the phone's activity.

IMO? I think that is bullshit. If someone causes injury or property damage in excess of a grand, police have every right to examine the time stamps of the activity in your phone, and what was going on there at the time of the accident.
