That’s false. Cannon does discuss whether Smith is an inferior officer or a principle officer, but ultimately does not make a decision one way or another because it has no real bearing on her decision as she found that there is no legal basis to appoint an inferior officer either.

By vesting The Authority it means giving the authority to the president, the courts of law, the heads of departments including the Attorney General as head of the Department of Justice to, appoint the inferior officer.
