He declassified them all before leaving office. He has that authority as President.
When the FBI first visited his resident to examine them, if they would had found any classified documents insecure, they were obligated to take the documents. But they didn’t, which means there were no classified documents.

He would still have to put it in front of a DC Grand jury, and Trump couldn't even get them to indict the Sandwich thrower.
Kind of hard for Trump to complain that something was sent over email when his boys were discussing war plans on an open server.
