Kash Patel Undermines His "Big Case" Against Wisconsin Judge

They were personal documents held by the President, and we never were told what they actually were.

I doubt they were the only copies, yet the archives made it into somehow a criminal case.

And ICE detainer sure as hell is legally binding.

On the other hand the classification system only has any power via the elected President.

False. none of the documents in question were private at all.

Had that been true, he should have made that case in court.

Instead. He stole, lied about stealing, had his lawyers lie for him, ignored requested and defied a subpoena.

They were his via him being President.

False again.

The Presidentiial Records act makes that clear.

This was Trump’s first attempt at an excuse when he got caught.

He lost that argument in court almost immediately.

Calling top secret DoD documents to be "personal" defies any logic or common sense. What is personal about documents detailing nuclear capabilities of a foreign country? The list of documents starts on page 32 of the indictment.

An ICE detainer is a request that does not need to be honored. It can be ignored with no legal repercussions.

(3) The term "personal records" means all documentary materials, or any reasonably segregable portion thereof, of a purely private or nonpublic character which do not relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President. Such term includes--

(A) diaries, journals, or other personal notes serving as the functional equivalent of a diary or journal which are not prepared or utilized for, or circulated or communicated in the course of, transacting Government business;

(B) materials relating to private political associations, and having no relation to or direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President; and

(C) materials relating exclusively to the President’s own election to the office of the Presidency; and materials directly relating to the election of a particular individual or individuals to Federal, State, or local office, which have no relation to or direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President.

And yet not a single mention of any consequences for not following these convoluted rules.

Then the Biden admin decided to make it a criminal lawfare attempt.

These rules are hardly convoluted. We shouldn't have to explain to you that classified DoD documents aren't "personal". That's obvious to anyone who isn't a hack.

The criminality comes from the obstruction of justice and willful retention of classified documents. That's not unusual. The government prosecutes these cases all the time.

It is time for many of these judges to go to prison. Teh taxpayers are on the hook for many illegals.

Pages and pages, sections and sections.

Nope, the dems turned a paperwork fight into a fake crime, same as with the checks in NY.

Taking home classified documents isn't a paperwork fight. It's definitely a crime and people get prosecuted for it all the time.

Do you seriously not understand this?

The Presidential records act doesn't care if they are classified or not. They want the records.

Stop moving the goalposts.

The Espionage Act cares if they're classified or not. Trying to claim they're personal records is just fucking pathetic.

It's true Jack Smith claimed all that, but, sadly couldn't prove it and his case was tossed out of court, largely due to the facthe was illegally appointed to begin with.

False again.

In fact, Trump’s lawyers played his signature delay game in court.
Show me where it "makes it clear"

I am not interested in relitigating your false claims.

This matter was adjudicated a long time ago.

The case was dismissed by a notoriously corrupt Trump judge on flimsy grounds.

Trump was never innocent.

It was actually the first of a whole series of false claims and excuses Trump offered.

His big break came when the case went in front of one of his stooges

It was never done because they realized they fucked up by starting the whole thing.

It blew up spectacularly in your face much like Kamala's squirting.

The records act gives the President a lot of leeway to do just that.
The fuck it does. The president can't change reality and the reality is that classified government documents aren't personal.

There's no coherent argument to claim that they are or ever could be.

For those who might have a genuine concern this judge broke the law, this should infuriate you. Your own team is undermining the case against the judge. It is a prosecutorial axiom that you try the case in court, and not the in public, as Patel is doing. It’s also a prosecutorial axiom that you don’t give the defense any freebie arguments through your own actions, as Patel is doing in this case. If nothing else Patel is giving defense counsel leverage in any plea agreement negotiations. At worst, his repeated flouting of guidelines aimed at protecting a fair trial for defendants risks a sympathetic judge dismissing the case.

Shouldn't be a problem, since Trump is in such good standing with the judiciary...
What a crock OP.

Of course the Government should not try their cases in the press. Nonetheless, the Government does have an obligation to inform the people of the actions it takes and the bases for those acts.

Doing so does not constitute anything along the lines of undermining the Government’s case.

Skrewball is dumber than a sack of AOC.
