The PRA doesn't give the president the authority to wave a magic wand and turn classified government documents into "personal documents" anymore than it could give the president the authority to declare the sky to be green.

Even if it could, that doesn't permit a former president to lie to the government about responding to a court ordered subpoena.

It could have been handled as an administrative matter, but Trump decided to play games and didn't leave the government any other choice.

If Trump had just handed the documents over when the archives requested it. If he had cooperated with law enforcement. None of this would have happened. He brought it on himself because of his behavior.

Taking home classified documents isn't a paperwork fight. It's definitely a crime and people get prosecuted for it all the time.

If that's the case, then why didn't former VP Pence and then Sen. Biden NOT get prosecuted over taking home or away from a SCIF classified documents? Returning them after being caught with them may be a factor in sentencing, but it doesn't excuse them from the act itself.

They'd have to prove they took the documents knowingly and willingly.

That's a lot easier for Trump given he was actively hiding them from investigators. If he had just turned everything over to the archives when they asked for it shortly after he left office, it would have been nearly impossible to prosecute him.

I must have missed where Trump invited the archivist to his house and asked them to search through his belongings looking for government documents. That’s because he didn’t and never would have allowed it voluntarily.

And when the FBI did come to take documents responsive to the subpoena, the visit where they swore that there wasn’t anything left, his lawyers explicitly forbade the FBI from looking at the boxes in the store room.

So Trump didn’t leave them any choice, did he?
