If Mr. Garcia isn't an MS-13 , he doesn't qualify to be housed in CECOT as that facility is only for certified gangsters and terrorists.

The officials at the penitentiary can recognize gang members by their tattoos, and if Garcia doesn't have them, he will be pulled out of line and sent to an ordinary penitentiary or freed into the El Salvadorean population- in the event he's an ordinary criminal or a law abider.

That optimistic scenario does not account for the injustice of his being sent to El Salvador in the first place.
 
If the government has any evidence of that they need to present it at a hearing in order to make the deportation abide by the law.

Court filings aren't enough to prove guilt. If they were trump would be in prison. The case needs to be adjudicated.

That the government said he was part of MS-13 for a location where he'd never lived.

The government was not able to produce police reports from the encounter where he was orgiainally detained in 2019.

Before she issued her ruling, U.S. District Judge Paula Xinis described Abrego Garcia’s deportation as “an illegal act” and pressed Justice Department attorney Erez Reuveni for answers, many of which he didn’t have.
