Likely with two of those "required qualifiers" being (a) during his term of office, and (B) for duties performed within the scope of the Office of the President.

Which of course would exclude:
  • Falsification of business records while a candidate (and President)
  • Failure to return classified documents after leaving office
  • Attempting as a candidate to illegal overturn an election
The above to be determined by a jury in a criminal court since they occurred after leaving office or were not with scope for the duties of the President.

The qualifiers don’t have to be guessed at. They already exist. The only possible difference is applying them to a criminal prosecution case.

For FPOTUS#45 the issue ISN'T when Cohen committed his crimes, it's when did FPOTUS#45 falsify the records.

When were the invoices processed?

When were the checks cuts and the business records updates?

If after Noon January 20, 2021 - then ya FPOTUS#45 would have been sworn in. So that's can impact how "immunity" gets thrown into the equation.

That is what they do not get, Don Snoreleone was NOT in elected office when the hush money payments were, no immunity is attached.

If you mean Cohen's payment, yes it was pre FPOTUS#45 being in office.

If you mean the payments FPOTUS#45 made through the the Trump Organization to Cohen, those occurred in 2017 so he would have been in office. (But, IMHO, paying a porn star is outside the scope of Presidential Duties so immunity wouldn't attach.)

I dont necessarily blame trump for trying this crazy tactic. After all, look at how many charges he's facing. The problem he's going to face, though, is who is he going to blame when the SCOTUS goes against him?

Not unless there is a federal law violation such discrimination based on the Voting Rights Act (race, religion, age, etc.), failure to comply with federal voter registration laws (for federal office), etc.

"Looking into" how states run their elections because he lost, might be something to do as a candidate, but it is not part of the duties of the Office of President.

Not one case is going to survive appeal... everyone knows that... its election tampering but it isn't working as they hoped... they thought the people would bail on Trump when all these case were brought... it has had the reverse effect so now they hope to keep him off the campaign trail and stuck in NYC... that isn't working either because the news media covers his words everyday and he may be turning NYC from blue to purple....

State legislatures are responsible for State elections, unless Congress passes law regarding a specific matter. Such as the Voting Rights Act of 1964.

Elections are run by the State, not the President.

Now, candidate Trump has a right to "look into" elections that he lost. No disagreement, but it is not within the scope of duties for the President of the United States.

Now be hones, you position would be completely different if FPOTUS#45 wins and it was POTUS#46 trying to change the results of state elections and attempted to submit fake electors to Congress.
