An Alaska Superior court judge has ordered the Fairbanks North Star Borough to release a majority of Republican Senate candidate Joe Miller's personnel files to the public.
Judge Winston Burbank ruled Saturday the public's right to know about candidates outweighed Miller's right to privacy. The records will not be released until Tuesday afternoon, to ensure both sides have enough time to appeal the decision to the Alaska Supreme Court.
A group of Alaskan media outlets including Alaska Dispatch, Fairbanks Daily News Miner, Anchorage Daily News and the Associated Press
sued for the records. The news organizations want certain personnel files related to Miller's resignation from the Fairbanks North Star Borough last year as a part-time attorney.
Two weeks ago Miller said he would no longer answer media questions regarding accusations that he resigned to avoid being fired, after he used work equipment in an attempt to unseat Alaska GOP Party Chair Randy Ruedrich in 2008.
However, in a national interview with CNN, Miller admitted he was disciplined for using borough computers on his lunch hour, calling it a petty issue.
Joe Miller's campaign spokesperson Randy DeSoto issued an e-mail statement after the ruling saying, "Joe is going to confer with his attorney to see if an appeal is even necessary."
