Congress members calls are part of the Congressional Record.
The phone records (metadata, i.e., who called whom, when, and for how long, but not the content of the conversation) of members and their staff can be obtained by law enforcement agencies through legal processes such as grand jury subpoenas, which typically come with non-disclosure orders to keep them secret during an active investigation. The content of the actual conversations can only be monitored with a court-ordered warrant, which also involves strict procedures and usually a requirement to notify the individual afterward (unless a court orders a delay).
So, where is the problem?
