The Trump administration said Monday the U.S. government will not return a Maryland resident it erroneously sent to a hard labor prison in El Salvador.
The refusal comes despite the Supreme Court unanimously upholding a lower-court ruling ordering it to “facilitate” the man’s return to the U.S. It’s the latest and perhaps most troubling example of the Trump administration undermining the rule of law by appearing to flatly defy judicial orders.
President Donald Trump last month invoked the Alien Enemies Act (AEA), an 18th-century wartime law, to transfer the man, Kilmar Abrego Garcia, and hundreds of other people to El Salvador.
In a meeting with El Salvador President Nayib Bukele Monday, Attorney General Pam Bondi claimed that the U.S. could not order El Salvador to return Abrego GarcĂa.
White House aide Stephen Miller said bringing Abrego GarcĂa back would constitute “kidnapping” and an “invasion of El Salvador’s sovereignty” and also falsely stated that the Supreme Court had ruled in the Trump administration’s favor.

I believe there is a hearing scheduled for tomorrow in the appeals court that initially made the "effectuate" ruling, instructing the regime to bring Garcia back to the US. I suppose that means the door is still not entirely shut for the regime. It may decide it needs to comply with the appeals court's order as well as the SC's. But maybe not. What happens if it decides not to comply.........I'm actually not sure.
This may be the moment JD Vance spoke about when he said, to paraphrase, "the courts can rule any way they want, let's see them enforce their ruling." If trump does not relent this may be his undoing. It can't come soon enough.

Large swaths of President Trump’s agenda have been tied up in court, challenged in scores of lawsuits. The administration has frozen money that the courts have ordered it to spend. It has blocked The Associated Press from the White House press pool despite a court order saying that the news organization be allowed to participate. And it ignored a judge’s instruction to return planes carrying Venezuelan immigrants bound for a notorious prison in El Salvador.
But Exhibit A in what legal scholars say is a deeply worrisome and escalating trend is the administration’s combative response to the Supreme Court’s ruling last week in the case of a Salvadoran immigrant. The administration deported the immigrant, Kilmar Armando Abrego Garcia, to El Salvador despite a 2019 ruling from an immigration judge specifically and directly prohibiting that very thing.
Until recently, none of this was in dispute. “The United States acknowledges that Abrego Garcia was subject to a withholding order forbidding his removal to El Salvador, and that the removal to El Salvador was therefore illegal,” the Supreme Court said on Thursday in an unsigned and to all appearances unanimous order.
