That would be up to the judge in a bond hearing. The government says why the defendant should be detained. The defendants gets to tell the judge why they shouldn't. Then the Judge makes the call.

So on the governments side you have: Wearing A Bulls Hat, A hoodie, and an informant from years ago that said he was in a New York gang while living in Maryland.

On the defendants side you have: gainfully employed, not criminal activity in 14 years, not criminal record in El Salvador, no gang activity, and the original judge in 2019 found that he was RUNNING from being forcefully inducted into a gang.

That's why we have judges making the call, so they can look at evidence instead of Bulls Hat + Brown Skin = Gang Member.

and the SCOTUS said he could. Not sure your point, Trump is using a law passed by Congress, to enforce immigration law, and deport members of a terrorist organization.

what US Citizens have been deported to El Salavador? Zero.

Wiht that said, if it's legally possible, I have no problem sending the convicted criminals there, but I doubt it is. I don't disagree with him, if it's possible to send them there, we should, they are terrorist and should be locked up

The judge you are referring to was for the bond proceeding where has very little evidence presented. Bond proceedings are limited in scope, short, and often without the ability to gather or present contravening evidence because of the short turnaround time.

The LATER judge, the Immigration Judge was a different judge. The judge could have retained the defendant in custody, but did not find the governments claims warranted continued detention. There was a 30 day appeal period (original entry in October 2019 which became permeant in November 2019), during which the Trump Administration DIDN'T file a motion for retention, DIDN'T appeal the Immigration Judges opinion, and ISSUED Aberg Garcia work authorization.

You apparently want only believe the bond judge but ignore the subsequent Immigration Judges ruling and Trump Administrations choice to not take action.

The bond hearing was before Judge Kessler was in April 2019, the actual immigration hearing dealing with asylum and the threat to his life funning away from gangs was before Judge Davis in October 2019.

In 2019 no one had heard the name Kilmar Abrego Garcia not that the Trump Administration had detained him, conducted an immigration hearing and released him, and awarded work authorization.

No, I choose to uphold immigration law, and not be an advocate for ignoring our laws because of the political implications or because of political schemes that attempt to skirt the laws for a broad left-wing agenda.

Immigration laws says you are entitled to due process before deportation and removal because any law made must follow the 5th amendment to the consitution. If you're choosing to upload immigration law why aren't you doing so in this case? Immigration law certainly doesn't say, that you can randomly be picked up off the street, dragged into a van, and deported to another country to be imprisoned and tortured. Even Trump's own administration admits it was a mistake to deport him. Now that a judge has ordered he'd be brought back what is Trump going to do? So far he's defied the judge's order. This is nothing short of naked fascism we're seeing here and a defiance of the 5th amendment.

The supreme court ruled that Garcia must be brought back to the United States. We are taking the word of SCOTUS, in this case, but it seems that you're not! Projecting much?
