What is being claimed is that the twelve $35,000 a month checks written to Cohen by Trump beginning in Feb. 2017 were payments for 2016 hushmoney payments and legal fees by Cohen on Trump's behalf. The evidence so far are Trump's check stubs and Cohen's invoices with details of the charges. Trump is not so stupid as to write Cohen a check for $420,000 just before the election. Apparently Trump didn't think that payments of $35,000 a month for legal fees of the Trump Organization would be question after the election. He was wrong.

Which means that the Bragg case is bogus on its face. Remember he's claiming that the payments TRUMP made to Cohen were to influence voters in the 2016 election, but the payments that TRUMP made weren't made until 2017...LONG AFTER the election so how could Trump's payments "influenced voters?"

The charge isn't that Trump's payments influenced voters. Cohen and Peckers illegal campaign contributions did that.

Section 175.10 of the New York State Penal Code is about the falsification of business records made after the fact to aid in and or conceal Cohen's and Peckers crimes.

Of the 34 indicted counts carrying a total maximum jail time of 136 years I doubt he'll actually get more than 12 behind bars.
He'll (possibly) be out by the age of 85 or 90.

At worst in deference to being an Ex-President and for security reasons he would be placed under in-home confinement.

(Personally I don't think even if found guilty he would be assigned any confinement.)

#2 The Daniels payment by Cohen was Oct 2016, Trumps first check was Feb 2017. That’s 4 months not “over a year” later and only 1 after being sworn in as President.
